Terms of Service
Effective April 29, 2026
These Terms govern your use of Photog Flow. By creating an account or using any feature of the service, you agree to them. Please read them.
We’ve tried to be specific and to mean what we say. If you have questions, email hello@photogflow.app.
1. Definitions
- “Photog Flow,” “we,” “us” — the company operating photogflow.app.
- “Service” — the Photog Flow web application, hosted booking pages, transactional email, AI features, and APIs.
- “You” — the person or entity that has accepted these Terms by creating an account.
- “Your content” — anything you upload to or create within Photog Flow: photographs, client contacts, messages, contracts, invoices, gallery contents.
- “Your clients” — the people you serve through Photog Flow whose data you upload.
- “Subscription” — a paid plan you maintain with us, billed via Stripe.
2. Acceptance of Terms
By creating an account, accessing Photog Flow, or using any feature of the Service, you confirm that:
- You are at least 18 years old.
- If you’re signing up on behalf of a business, you have authority to bind that business, and references to “you” include both you personally and that business.
- You will comply with these Terms and applicable law.
If you do not agree to these Terms, do not use Photog Flow.
3. The Service
Photog Flow is a software-as-a-service platform built for wedding and couples photographers. It includes lead and project management, client communications, contracts, invoices, galleries, scheduling, calendar sync, AI drafting, a hosted website builder, and related tools.
Features evolve. We may add, change, or remove capabilities. For material removals or breaking changes, we will give reasonable advance notice via email or in-app announcement.
4. Accounts
You are responsible for keeping your login credentials confidential and for everything that happens under your account. If you suspect unauthorized access, notify us at hello@photogflow.app and change your password immediately. You are responsible for any losses due to your failure to safeguard credentials.
We may suspend or terminate accounts that:
- Contain materially inaccurate registration information.
- Are used to violate these Terms or applicable law.
- Repeatedly fail payment.
- Pose a security risk to Photog Flow or other users.
We will give you reasonable notice and an opportunity to cure where practical, except in cases involving fraud, abuse, or imminent harm.
5. Subscriptions and payment
Pricing. Current pricing is shown on photogflow.app/pricing. Prices are in US dollars and exclude taxes that may apply in your jurisdiction.
Billing. Subscriptions are billed in advance for each period (monthly unless otherwise specified) through Stripe. By providing a payment method, you authorize us to charge it for the recurring fee until you cancel.
Trial. New accounts get a 14-day free trial. We do not require a payment method to start the trial. If you have not added a payment method by the end of the trial, the account moves to a read-only state and can be deleted by you at any time.
Refunds. Subscription fees are non-refundable except where required by law. If you cancel mid-period, you retain access through the end of the period.
Failed payments. If a charge fails, we will retry over the following 14 days. After 14 days of unpaid balance, we may suspend the account until payment is resolved. After 30 days, we may terminate the account.
Price changes. We may change subscription prices for future billing periods. We will give at least 30 days’ notice via email before any price change takes effect; you may cancel before the change applies.
6. Stripe Connect and client payments
Photog Flow uses Stripe Connect Standard so that payments your clients make for your services flow into your own Stripe account, not ours. Photog Flow does not take any percentage fee on client payments routed through your Stripe account.
You are responsible for completing Stripe’s onboarding (which includes identity verification and bank account confirmation) and for complying with Stripe’s terms. Stripe’s fees apply to all transactions; we do not add to them.
If your Stripe account is restricted, frozen, or terminated by Stripe, we cannot release funds — they are not in our possession. You will need to resolve the issue with Stripe directly.
7. Your content
You retain full ownership of everything you upload to or generate within Photog Flow. To operate the Service on your behalf, you grant Photog Flow a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, display, and back up your content. This license terminates when you delete the content, except for backup copies that age out per our retention schedule (see Privacy Policy).
You represent and warrant that:
- You have all rights necessary to upload and use your content within Photog Flow.
- Photographs of identifiable people are uploaded with appropriate model releases or other permissions where the law or your own contracts require them.
- Your content does not violate any third party’s rights or applicable law.
8. Acceptable use
You agree not to use Photog Flow to:
- Store or distribute illegal content.
- Upload child sexual abuse material (CSAM). Strictly prohibited; reported to NCMEC and law enforcement on detection.
- Transmit malware, ransomware, viruses, or other harmful code.
- Infringe any third party’s copyright, trademark, trade secret, or other intellectual property right.
- Harass, defame, or threaten any individual, including other Photog Flow users.
- Send spam or unsolicited bulk email through our outbound mail system.
- Reverse-engineer, decompile, or attempt to extract source code from the Service except where law expressly permits.
- Resell, sublicense, or redistribute API access without our written consent.
- Probe, scan, or test the security of the Service without authorization.
- Use the Service to compete with us by building a substantially similar product.
We may suspend access in response to violations and we will cooperate with law enforcement when legally required.
9. AI features
Photog Flow includes AI-powered features (collectively, “Flo”) that draft content, summarize threads, and prepare actions for your review. Output is a suggestion, not advice.
- AI output is not legal, financial, medical, tax, or other professional advice.
- You are solely responsible for reviewing AI output before sending it to clients, publishing it, or relying on it.
- AI output may contain inaccuracies, fabrications, or biases despite our efforts to mitigate them.
- Anthropic processes prompts under their commercial terms (no training on our customers’ data). We do not transmit your full database to Anthropic — only the specific context relevant to each request.
The “drafter, not sender” gate inside Flo exists specifically because AI output requires human review before it reaches a client. You acknowledge this gate and accept responsibility for anything you ultimately send.
10. Third-party services
Photog Flow depends on third-party providers — Stripe, Supabase, Resend, Sentry, PostHog, Anthropic, Vercel, Google Cloud — listed in our Privacy Policy. Each provider has its own terms; using a Photog Flow feature that depends on that provider means your activity is also subject to their terms.
We are not responsible for the acts or omissions of third-party providers, but we will work in good faith to maintain reliable integrations.
11. Copyright complaints (DMCA)
If you believe content on Photog Flow infringes your copyright, send a written notice to hello@photogflow.app that includes:
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the allegedly infringing material — the URL or specific gallery / post.
- Your contact information.
- A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act on the owner’s behalf.
- Your physical or electronic signature.
We will remove material we determine is infringing and may terminate accounts of repeat infringers. If your content was removed and you believe in good faith it was a mistake, you may submit a counter-notice with the corresponding statutory elements (17 U.S.C. § 512(g)).
12. Service availability and disclaimer of warranties
We work to keep Photog Flow available and performant, but we do not offer a service level agreement (SLA) on standard plans. The Service is provided “as is” and “as available.”
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or trade usage.
We do not warrant that the Service will be uninterrupted, error-free, or secure against every threat. We do not warrant that AI output will be accurate.
13. Limitation of liability
To the maximum extent permitted by law:
- Our aggregate liability for any claim arising out of or relating to these Terms or the Service is limited to the greater of (a) the amounts you paid us in the 12 months preceding the event giving rise to the claim, or (b) one hundred US dollars ($100).
- We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, even if advised of the possibility.
These limits do not apply to: (i) liability that cannot be excluded under applicable law, (ii) gross negligence or willful misconduct, (iii) fraud, or (iv) breach of confidentiality obligations.
Some jurisdictions (notably some US states and the EU) do not allow certain limitations of liability. If you live in one, the disclaimers and limitations above apply only to the maximum extent permitted in your jurisdiction.
14. Indemnification
You agree to indemnify, defend, and hold harmless Photog Flow from any claim, damage, loss, liability, cost, or expense (including reasonable attorneys’ fees) arising out of:
- Your content or your use of the Service.
- Your violation of these Terms.
- Your violation of any third party’s rights, including intellectual property and privacy rights.
- Your violation of applicable law.
We agree to indemnify, defend, and hold you harmless from any third-party claim that the Service, as provided to you, infringes that party’s US intellectual property rights — provided you (a) notify us promptly, (b) give us sole control of defense and settlement, and (c) reasonably cooperate.
If we receive an IP claim, we may at our option modify the Service to be non-infringing, obtain a license, or terminate the affected feature with a prorated refund.
15. Termination
By you. You may cancel your subscription at any time from Settings › Billing. Cancellation takes effect at the end of the current billing period; you retain access until then. You may delete your account at any time from Settings › Account.
By us. We may suspend or terminate the Service to you for: violation of these Terms, repeated failed payment, or legal requirement. We will give reasonable notice except in cases of urgent harm.
On termination. We retain your data in a recoverable state for 30 days so you can export it. After 30 days the data is scheduled for permanent deletion. Backups age out per our retention schedule.
What survives. Sections 7 (your content license, limited to backup), 9 (AI disclaimers), 10 (third-party services), 12 (warranty disclaimers), 13 (limitation of liability), 14 (indemnification), 16 (governing law and dispute resolution), and any other provision that by its nature should survive, survive termination.
16. Governing law and dispute resolution
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws rules.
We prefer to resolve disputes informally. Before filing any formal action, please contact us at hello@photogflow.app and give us 30 days to address the issue.
If we can’t resolve a dispute informally, any dispute arising out of or relating to these Terms or the Service will be brought in the state or federal courts located in California, and both parties consent to their exclusive personal jurisdiction. Both parties waive any objection to venue.
We do not require arbitration or waive your right to a jury trial.
17. Force majeure
Neither party is liable for failure to perform under these Terms when caused by events beyond reasonable control — natural disasters, acts of war or terrorism, pandemics, government action, internet or utility failures, or third-party service outages outside our control.
18. Notices
We deliver notices to the email address associated with your account. You may give notice to us at hello@photogflow.app. Notices are deemed received the next business day after sending.
19. Changes to these Terms
We may update these Terms as the product or law evolves. For material changes, we will email the address on file at least 30 days before the change takes effect. Continued use after the effective date counts as acceptance.
20. Miscellaneous
Entire agreement. These Terms, together with the Privacy Policy and any DPA you have signed with us, constitute the entire agreement between you and Photog Flow regarding the Service.
Severability. If any provision of these Terms is found unenforceable, the remaining provisions stay in effect.
Waiver. A failure to enforce a provision is not a waiver of the right to enforce it later.
Assignment. You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, or sale of substantially all our assets, on notice to you.
Headings. Section headings are for convenience and do not affect interpretation.
No agency. Nothing in these Terms creates a partnership, agency, joint venture, or employment relationship between us.
